General Terms and Ordering Conditions

1. Validity and Scope of the Terms

1.1. These terms apply to legal relationships arising from purchases made through the online environment https://kruathai.ee/ (hereinafter referred to as the KruaThai online store/seller) and all purchasers (hereinafter referred to as the Customer/Buyer).

1.2. In addition to these terms, legal relationships arising from the purchase of products from the online store shall be governed by the laws and regulations of the Republic of Estonia.

1.3. The online store reserves the right to amend and supplement these terms and the price list in connection with the development of the online store and to ensure better and safer use thereof. Changes will be announced on https://kruathai.ee/. Amendments enter into force upon publication on the website. If an order was placed before the amendments entered into force, the terms valid at the time of placing the order shall apply, unless otherwise provided by law.

2. Prices

2.1. The prices displayed in the online store are valid provided that payment is made in accordance with Section 4.

2.2. All prices are displayed in euros (EUR) and include VAT in accordance with the applicable legislation of the Republic of Estonia.

3. Placing an Order

3.1. The Customer selects the desired product from the online store and adds it to the shopping cart by clicking the “Add to Cart” button.

3.2. To complete the order, the Customer proceeds to the shopping cart page and clicks “Proceed to Checkout,” after which they are directed to the order confirmation page.

3.3. After entering the required information and verifying its accuracy, the Customer confirms the order by clicking “Confirm and Pay.” The order is then submitted to the Seller.

3.4. The Customer pays for the order immediately via online banking or another available payment method and confirms the payment.

3.5. The Customer undertakes to provide accurate and complete information required for order fulfillment.

3.6. The Seller shall not be liable for failure to fulfill an order or any consequences thereof if caused by inaccurate information provided by the Customer.

3.7. The Seller has the right to cancel the fulfillment of an order if there is reason to doubt the accuracy of the information provided or if the Customer’s conduct is contrary to good practice.

4. Payment Methods

4.1. Orders can be paid securely through Estonian bank links (including Swedbank, SEB, LHV, Coop Pank and others) as well as by credit and debit cards (Visa, MasterCard, Maestro).

4.2. Payments are processed by a payment service provider outside the online store environment.

4.3. The Seller has no access to the Customer’s bank account or credit card details.

5. Delivery of Orders

5.1. We offer delivery of orders in Tallinn through a courier service partner.

5.2. Orders are delivered according to the submitted order details by a courier service partner.

5.2.1. The courier delivers the order to the address specified by the Customer when placing the order. The Customer is responsible for the accuracy of the address provided.

5.3. Customers are requested to verify the correctness of their contact details to avoid delays and misunderstandings during delivery. The courier shall not be liable for delays caused by incorrect information provided by the Customer.

5.4. The order is handed over to the Customer together with the accompanying receipt. Any issues must be reported to the Seller immediately. Claims submitted after delivery has been completed will not be accepted.

5.5. If the order has not arrived in proper condition and in a sealed package, the Customer must notify the restaurant and send an email with photographs to kruathai@gmail.com.

6. Order Cancellation and Returns

6.1. Orders cannot be returned if the food has been prepared according to the Customer’s personal requirements or specifications.

6.2. If a returned order or packaging has been damaged due to improper use, the Seller has the right to reduce the refund amount by the value of the damage and refund the remaining amount to the Customer.

6.3. Order confirmation and fulfillment details will be sent to the contact information provided by the Customer.

6.4. If an order is cancelled due to an inconvenient fulfillment time, the Seller will contact the Customer to find a suitable solution. If no agreement can be reached, the order amount will be refunded to the Customer’s bank account within three business days.

6.5. An order may be cancelled without providing a reason up to 24 hours before the scheduled fulfillment time.

7. Liability and Force Majeure

7.1. The Seller and the Customer shall be liable to each other for damages caused by a breach of these terms to the extent provided by the laws of the Republic of Estonia.

7.2. The Seller shall not be liable for damage or delays in delivery caused by force majeure circumstances.

8. Data Protection and Processing of Personal Data

8.1. All personal data of Customers obtained during visits to the online store and purchases shall be treated as confidential information.

8.1.1. The online store uses Customer personal data (name, phone number, address, email address) solely for order processing and delivery purposes.

8.2. The Seller processes Customer data in accordance with its Privacy Policy.

8.3. If the Customer has given consent for marketing purposes, the Seller may send personalized offers, campaigns, and discounts through electronic communication channels (such as email or SMS).

8.4. The Customer has the right to withdraw consent to receive marketing communications at any time by notifying the Seller or by using the unsubscribe link provided in such communications.

8.5. Matters not regulated by these terms shall be governed by the laws of the Republic of Estonia.

8.6. Disputes between the Customer and the Seller shall be resolved through negotiations. If no agreement can be reached, the Customer has the right to обратиться в Consumer Protection and Technical Regulatory Authority or a competent court.

9. Disclaimer

9.1. Product images are for illustrative purposes only.

9.2. The Seller reserves the right to change product prices and availability and, in exceptional cases, to refuse a sale.

9.3. Product information is regularly reviewed and updated. Some information may have changed since your last visit.
